Agreement to Terms

By accessing or using American Iron Gym's services ("Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our Services.

These Terms apply to all users of the platform, including members, trainers, athletes, and visitors.

Description of Services

American Iron Gym provides a comprehensive fitness platform including:

• Gym membership management and check-in services
• Personal training session booking (in-person and remote)
• Remote training with Google Meet video integration
• Workout planning and tracking
• Nutrition guidance and meal planning
• Equipment tracking and maintenance reporting
• Trainer and athlete marketplace
• Payment processing and billing

Account Registration

To use certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account
• Be at least 18 years old or have parental/guardian consent

User Responsibilities

For All Users

• Comply with all applicable laws and regulations
• Use the Services only for lawful purposes
• Not impersonate others or provide false information
• Not interfere with or disrupt the Services
• Not attempt to gain unauthorized access to systems
• Respect intellectual property rights

For Members/Clients

• Attend scheduled sessions or cancel with appropriate notice
• Follow gym rules and equipment guidelines
• Communicate respectfully with trainers and staff
• Pay for services and memberships on time
• Consult healthcare providers before beginning training programs

For Trainers and Athletes

• Maintain appropriate certifications and credentials
• Provide professional and safe training services
• Honor scheduled sessions or provide timely cancellations
• Protect client privacy and confidentiality
• Accurately represent your qualifications and services

Payments and Billing

Membership Fees

Membership fees are billed according to your selected plan (monthly, quarterly, or annually). Payments are processed automatically on your billing date. You are responsible for maintaining valid payment information.

Training Packages

• One-time packages must be paid in full at purchase
• Recurring training subscriptions are billed monthly
• Session credits expire according to package terms
• Unused credits are generally non-refundable

Refund Policy

Refunds are handled on a case-by-case basis. Contact us at davidhamilton473@gmail.com to request a refund. Memberships may be subject to cancellation fees as outlined in your membership agreement.

Cancellation and Rescheduling

Training Sessions

• Members must cancel or reschedule at least 24 hours before a session
• Late cancellations (less than 24 hours) may forfeit the session credit
• No-shows will forfeit the session credit
• Trainers should provide 24 hours notice for cancellations when possible

Membership Cancellation

To cancel your membership, submit a cancellation request through your account settings or contact support. Cancellations take effect at the end of your current billing period. Prepaid memberships are non-refundable.

Google Calendar Integration

Trainers may connect their Google account to automatically create Google Meet links for remote sessions. By connecting your Google account:

• You authorize us to create and manage calendar events for training sessions
• You agree to our use of Google Calendar API as described in our Privacy Policy
• You can disconnect your Google account at any time
• You are responsible for maintaining your Google account security

Health and Safety

Important: Consult with a healthcare provider before starting any fitness program. By using our Services, you acknowledge that:

• Physical exercise involves inherent risks
• You are physically capable of participating in fitness activities
• You will discontinue activities if you experience pain or discomfort
• You release American Iron Gym and its trainers from liability for injuries
• You have adequate health insurance coverage

Intellectual Property

All content, features, and functionality of the Services are owned by American Iron Gym and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or attempt to extract source code
• Create derivative works based on our Services

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, AMERICAN IRON GYM SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Indemnification

You agree to indemnify and hold harmless American Iron Gym, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of the Services
• Your violation of these Terms
• Your violation of any third-party rights
• Your content or conduct on the platform

Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Failure to pay fees
• Abuse or harassment of staff or members
• Any other reason at our sole discretion

Upon termination, your right to use the Services immediately ceases. We may delete your account data.

Dispute Resolution

Any disputes arising from these Terms or your use of the Services shall be resolved through binding arbitration rather than in court, except where prohibited by law. You waive your right to participate in class action lawsuits.

Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use after changes constitutes acceptance of the new Terms.

Governing Law

These Terms are governed by the laws of El Salvador, without regard to conflict of law principles.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

Entire Agreement
